Object of the Service<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This document regulates the terms and conditions for the booking and provision of <strong>legal advice<\/strong>, both in mode <strong>online<\/strong> (via videoconferencing tools) both <strong>in presence<\/strong>, offered by Lawyer Jawad Asmahi, with office in Bologna, VAT number 03969481203, registered with the Bologna Bar Association and the Ilustre Colegio de Abogados de Madrid.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>2. Booking the Consultation<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The consultation booking takes place via a specific <strong>online booking tool<\/strong> present on the website <a href=\"https:\/\/studiolegaleonline.it\/prenotazione\">https:\/\/studiolegaleonline.it\/prenotazione<\/a>. At the time of booking, the customer is required to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Fill in the required fields with truthful and updated information;<\/li>\n\n\n\n<li>Accept the presents <strong>Terms and Conditions<\/strong> and the<strong>Privacy Policy<\/strong>;<\/li>\n\n\n\n<li>Please wait for the email <strong>prepayment instructions<\/strong>.<\/li>\n<\/ul>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>Attention<\/strong>: The reservation is intended <strong>actually confirmed only after payment has been made<\/strong> according to the methods indicated.<\/p>\n<\/blockquote>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>3. Payment<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Payment of the consultancy fee must be made <strong>beforehand<\/strong>, according to the instructions sent by email to the address provided during booking.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Payment must be received <strong>within 48 hours<\/strong> from receiving the email, under penalty of automatic cancellation of the appointment request;<\/li>\n\n\n\n<li>Payment can be made by PayPal, credit cards, bank transfer or other payment systems indicated;<\/li>\n\n\n\n<li>The cost of the consultation is the one indicated on the booking page, including VAT, if applicable.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>4. Appointment Confirmation<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The final confirmation of the appointment will take place <strong>only after the actual crediting of the payment<\/strong>. The client will receive a confirmation email with all the details regarding the date, time and method (online or in person) of the consultation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>5. Failure to Provide Consultancy<\/strong><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">5.1 <strong>Customer&#039;s inability<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">In case the customer:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Do not show up at the agreed appointment;<\/li>\n\n\n\n<li>Please show up with <strong>over 15 minutes late<\/strong>, which could compromise the duration of the consultation;<\/li>\n\n\n\n<li>Not be available in the case of online consultation;<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>will not be entitled to any refund<\/strong>, except for proven reasons of force majeure communicated promptly (at least 24 hours in advance).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, at the discretion of the Attorney, it may be <strong>agreed a new appointment<\/strong>, subject to the law firm&#039;s availability.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">5.2 <strong>Impossibility of the Lawyer<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">In the event that the Lawyer is unable to provide the consultancy due to causes attributable to him or due to exceptional events (e.g. technical problems, professional impediments, force majeure):<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The customer will be promptly informed;<\/li>\n\n\n\n<li>It will be agreed <strong>a new date<\/strong> for the appointment, at no additional cost;<\/li>\n\n\n\n<li>If it is not possible to schedule a new appointment, the payment already made will be <strong>fully refunded<\/strong> within 7 working days.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>6. Customer withdrawal (for consumers only)<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Pursuant to the <strong>Legislative Decree 206\/2005 (Consumer Code)<\/strong>, since it is a <strong>personalized service and made by appointment<\/strong>, <strong>the 14-day right of withdrawal does not apply<\/strong>, pursuant to art. 59, paragraph 1, letters a) and c).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>7. Obligations of the Parties<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Customer undertakes to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Provide truthful and complete information to enable a correct legal assessment of the case;<\/li>\n\n\n\n<li>Comply with the payment and participation methods for the consultation;<\/li>\n\n\n\n<li>Do not use the Service for any purpose contrary to law or legal ethics.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The Lawyer undertakes to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Offer a professional service in compliance with the rules of forensic ethics;<\/li>\n\n\n\n<li>Respect professional secrecy;<\/li>\n\n\n\n<li>Process the Customer&#039;s personal data in compliance with the GDPR regulations.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>8. Privacy and Data Processing<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Customer is invited to consult the<strong>Privacy Policy<\/strong> available on <a href=\"https:\/\/studiolegaleasmahi.it\/en\/privacy\/\">https:\/\/studiolegaleasmahi.it\/privacy<\/a> drawn up pursuant to the <strong>Articles 13-14 of Regulation (EU) 2016\/679 (GDPR)<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The data collected will be used exclusively for purposes related to the management of the consultancy and will never be transferred to unauthorized third parties.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>9. Competent Court<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">For any dispute relating to the interpretation or execution of this contract, the Court of Bologna will have exclusive jurisdiction, except in the case in which the Customer acts as <strong>consumer<\/strong>, in which case the court of the place of residence or domicile of the Customer will be competent pursuant to art. 66-bis of the Consumer Code.<\/p>","protected":false},"excerpt":{"rendered":"<p>1.
