Let&#039;s clarify an urban legend"},"content":{"rendered":"<p class=\"wp-block-paragraph\">Lately, an old rumor has been circulating on social media and in everyday conversation: \u201cWhen a Pope dies, there is always an amnesty or a pardon!\u201d But is it really so? How much truth is there in this statement? And above all, what exactly are <strong>amnesty<\/strong>, <strong>pardon<\/strong> And <strong>grace<\/strong>? In this article we try to clarify, starting from a fundamental premise: <strong>There is no law that automatically provides for clemency measures upon the death of a Pope<\/strong>.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"683\" src=\"https:\/\/studiolegaleasmahi.it\/wp-content\/uploads\/2025\/04\/Amnistia-indulto-papa-morte-1024x683.png\" alt=\"\" class=\"wp-image-2801\" srcset=\"https:\/\/studiolegaleasmahi.it\/wp-content\/uploads\/2025\/04\/Amnistia-indulto-papa-morte-1024x683.png 1024w, https:\/\/studiolegaleasmahi.it\/wp-content\/uploads\/2025\/04\/Amnistia-indulto-papa-morte-300x200.png 300w, https:\/\/studiolegaleasmahi.it\/wp-content\/uploads\/2025\/04\/Amnistia-indulto-papa-morte-768x512.png 768w, https:\/\/studiolegaleasmahi.it\/wp-content\/uploads\/2025\/04\/Amnistia-indulto-papa-morte-18x12.png 18w, https:\/\/studiolegaleasmahi.it\/wp-content\/uploads\/2025\/04\/Amnistia-indulto-papa-morte.png 1536w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">Amnesty and pardon: what they are and what are the differences<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Amnesty<\/strong> And <strong>pardon<\/strong> there are two <strong>collective clemency measures<\/strong>, provided for by art. 79 of the Italian Constitution. These are exceptional instruments with which the State decides, for reasons of particular political, social or humanitarian relevance, to &quot;pardon&quot; in whole or in part penalties or crimes. Both require a <strong>law approved by Parliament with a qualified majority of two thirds<\/strong>.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Amnesty<\/strong>: extinguishes the crime itself. This means that the act is no longer punishable and the trial, if still in progress, is closed. However, it does not cancel the civil effects of the crime.<\/li>\n\n\n\n<li><strong>Pardon<\/strong>: does not extinguish the crime, but <strong>condones the sentence<\/strong>, in whole or in part, already imposed by a final judgment. It therefore does not affect the recognition of criminal liability.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">And grace?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Different is the <strong>grace<\/strong>, provided for by art. 87 of the Constitution. It is a <strong>individual provision<\/strong>, granted by the President of the Republic, <strong>on the proposal of the Minister of Justice<\/strong>, which extinguishes or commutes the sentence of a specific person. It does not require a parliamentary law and can be granted even against the opinion of the judge.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The Legend of Papal Clemency: Where Does It Come From?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The idea that upon the death of a Pope an amnesty or pardon is automatically granted <strong>it has no legal basis<\/strong>This is an urban legend that probably originates from episodes <strong>historical events that happened in the Vatican<\/strong>, where, in the past, the Popes granted <strong>acts of clemency<\/strong> against prisoners of the <strong>Papal State<\/strong> on the occasion of special events, such as the election or death of the Pope.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, <strong>the Italian Republic is a secular state<\/strong>, and its institutions function autonomously and independently from the Church. Neither the death of a Pope nor other religious events have <strong>no automatic impact<\/strong> on the granting of clemency measures by the Italian State.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The relevance of the question: what if it really happened?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">It is true that in historical moments of particular social or political tension, amnesty or pardon measures have been discussed \u2013 and sometimes approved (think of the pardon of 2006). However, <strong>their approval is always the result of a complex parliamentary debate<\/strong> and requires the agreement of a large part of the political forces.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The possible death of Pope Francis, while having an enormous symbolic and spiritual impact for millions of people, <strong>would not in itself constitute a legal or institutional basis<\/strong> to adopt an amnesty or pardon measure. Any proposal in this sense should in any case be discussed and approved by Parliament, with the procedures provided for by the Constitution.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Conclusions<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In an age where news travels fast, it is essential to distinguish between reality and suggestion. <strong>Amnesty and pardon are important but exceptional tools<\/strong>, the application of which can never be automatic, nor tied to religious events.
