1. Object of the Service

This document regulates the terms and conditions for the booking and provision of legal advice, both in mode online (via videoconferencing tools) both in presence, offered by Lawyer Jawad Asmahi, with office in Bologna, VAT number 03969481203, registered with the Bologna Bar Association and the Ilustre Colegio de Abogados de Madrid.

2. Booking the Consultation

The consultation booking takes place via a specific online booking tool present on the website https://studiolegaleonline.it/prenotazione. At the time of booking, the customer is required to:

  • Fill in the required fields with truthful and updated information;
  • Accept the presents Terms and Conditions and thePrivacy Policy;
  • Please wait for the email prepayment instructions.

Attention: The reservation is intended actually confirmed only after payment has been made according to the methods indicated.

3. Payment

Payment of the consultancy fee must be made beforehand, according to the instructions sent by email to the address provided during booking.

  • Payment must be received within 48 hours from receiving the email, under penalty of automatic cancellation of the appointment request;
  • Payment can be made by PayPal, credit cards, bank transfer or other payment systems indicated;
  • The cost of the consultation is the one indicated on the booking page, including VAT, if applicable.

4. Appointment Confirmation

The final confirmation of the appointment will take place only after the actual crediting of the payment. The client will receive a confirmation email with all the details regarding the date, time and method (online or in person) of the consultation.

5. Failure to Provide Consultancy

5.1 Customer's inability

In case the customer:

  • Do not show up at the agreed appointment;
  • Please show up with over 15 minutes late, which could compromise the duration of the consultation;
  • Not be available in the case of online consultation;

will not be entitled to any refund, except for proven reasons of force majeure communicated promptly (at least 24 hours in advance).

However, at the discretion of the Attorney, it may be agreed a new appointment, subject to the law firm's availability.

5.2 Impossibility of the Lawyer

In the event that the Lawyer is unable to provide the consultancy due to causes attributable to him or due to exceptional events (e.g. technical problems, professional impediments, force majeure):

  • The customer will be promptly informed;
  • It will be agreed a new date for the appointment, at no additional cost;
  • If it is not possible to schedule a new appointment, the payment already made will be fully refunded within 7 working days.

6. Customer withdrawal (for consumers only)

Pursuant to the Legislative Decree 206/2005 (Consumer Code), since it is a personalized service and made by appointment, the 14-day right of withdrawal does not apply, pursuant to art. 59, paragraph 1, letters a) and c).

7. Obligations of the Parties

The Customer undertakes to:

  • Provide truthful and complete information to enable a correct legal assessment of the case;
  • Comply with the payment and participation methods for the consultation;
  • Do not use the Service for any purpose contrary to law or legal ethics.

The Lawyer undertakes to:

  • Offer a professional service in compliance with the rules of forensic ethics;
  • Respect professional secrecy;
  • Process the Customer's personal data in compliance with the GDPR regulations.

8. Privacy and Data Processing

The Customer is invited to consult thePrivacy Policy available on https://studiolegaleasmahi.it/privacy drawn up pursuant to the Articles 13-14 of Regulation (EU) 2016/679 (GDPR).

The data collected will be used exclusively for purposes related to the management of the consultancy and will never be transferred to unauthorized third parties.

9. Competent Court

For any dispute relating to the interpretation or execution of this contract, the Court of Bologna will have exclusive jurisdiction, except in the case in which the Customer acts as consumer, in which case the court of the place of residence or domicile of the Customer will be competent pursuant to art. 66-bis of the Consumer Code.
